1. Our commitment
Specter Design and Automotive Inc. is committed to protecting the personal information of our customers in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and, for residents of Québec, the Act respecting the protection of personal information in the private sector (Law 25 / Act 64).
2. Who we are
The organization responsible for your personal information is Specter Design and Automotive Inc., doing business as Chez Specter, based in Montreal, Québec, Canada.
Our Privacy Officer is responsible for overseeing our privacy practices and handling requests and complaints. You can reach the Privacy Officer at: info@chezspecter.com.
3. Scope of this policy
This Privacy Policy applies to personal information collected through the chezspecter.com website, including the online store, checkout process, customer account features, and contact form. It does not apply to the personal information of our employees or job applicants.
4. Categories and sources of personal information
We collect the following categories of personal information:
- Account information: Name, email address, and (in hashed form) password when you create an account.
- Order information: Shipping and billing address, order contents, and order history.
- Payment confirmation: We do not store your full card number or CVV. Payment data is transmitted directly to Stripe and governed by their privacy policy. We retain only confirmation references.
- Communications: Messages submitted through the contact form and email exchanges with our team.
- Usage data: Pages visited and session data, collected only when you have granted analytics consent through our cookie preference panel.
Information is collected directly from you when you create an account, place an order, submit a contact request, or interact with the website. Anonymous usage data may be collected automatically by Google Analytics when you consent.
5. Purposes for collection, use and disclosure
We use your personal information to:
- Process and fulfil your orders, including preorders and deposit billing.
- Communicate with you about your order status, production updates, and balance due dates.
- Provide customer support and respond to your inquiries.
- Detect and prevent fraud and unauthorized transactions.
- Send marketing and promotional emails, only when you have provided separate express consent.
- Analyze website usage and improve our products and services, only with your analytics consent.
- Comply with applicable legal obligations.
We will not use or disclose your personal information for purposes other than those listed above without your consent, or as required or permitted by law.
6. Service providers and disclosures
We share your personal information with third-party service providers who perform services on our behalf. These providers are contractually obligated to protect your information and to use it only as directed by us.
- Stripe — Payment processing. When you complete checkout, relevant order and payment information is shared with Stripe, Inc. Stripe's privacy policy governs their handling of your data.
- Email service provider — Transactional order confirmation and balance-payment emails are sent through our configured email provider.
- Google Analytics — If you grant analytics consent, anonymized usage data is shared with Google LLC. Google Analytics is configured to deny all ad-related storage by default; analytics storage is granted only upon your explicit consent.
We do not sell your personal information to third parties.
7. Processing or storage outside Québec or Canada
Some of our service providers process personal information outside Canada. Stripe, Inc. is headquartered in the United States. Google LLC operates global infrastructure. When personal information is transferred outside Canada, it may be subject to the laws of the country where it is processed, which may not provide the same level of protection as Canadian law.
We take reasonable contractual measures, such as data processing agreements, to ensure that personal information transferred outside Canada remains protected in a manner consistent with applicable Canadian privacy law.
8. Retention and secure destruction
We retain personal information only as long as necessary for the purposes for which it was collected, and to comply with legal obligations (for example, tax and accounting record-keeping requirements). When personal information is no longer needed, it is securely deleted or anonymized.
9. Security safeguards
We implement technical and organizational measures to protect personal information against unauthorized access, disclosure, loss, or destruction. These measures include HTTPS encryption, hashed password storage, and access controls limiting who can view customer data.
In the event of a privacy incident involving personal information that presents a real risk of significant harm, we will notify the Office of the Privacy Commissioner of Canada (and, for Québec residents, the Commission d'accès à l'information) and the affected individuals as required by law.
11. Marketing communications and CASL consent
We send commercial electronic messages (newsletters, promotions, and product updates) only when you have provided express or implied consent in compliance with Canada's Anti-Spam Legislation (CASL). You can withdraw consent and unsubscribe at any time by using the unsubscribe link in any marketing email or by contacting us at info@chezspecter.com.
Accepting our Terms and Conditions at checkout, placing an order, or using the contact form does not constitute consent to receive marketing emails.
12. Access, correction, deletion and complaint rights
You have the right to:
- Request access to the personal information we hold about you.
- Request correction of inaccurate or incomplete personal information.
- Request deletion of your personal information, subject to legal retention obligations.
- If you are a Québec resident, request portability of personal information collected in a technology-based context.
To exercise any of these rights, please contact our Privacy Officer at info@chezspecter.com. We will respond within 30 days of receiving your request, or within the timeframe required by law.
If you are not satisfied with our response, you may file a complaint with the Office of the Privacy Commissioner of Canada (OPC) at priv.gc.ca or, for Québec residents, with the Commission d'accès à l'information (CAI).
13. Children's information
This website is not directed at children under the age of 13, and we do not knowingly collect personal information from children. If you believe we have inadvertently collected personal information from a child, please contact us and we will delete it promptly.
14. Policy updates
We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. Material changes will be communicated on the website. The "Last updated" date at the top of this page indicates when the Policy was most recently revised.
