1. Merchant identity and contact information

This website is operated by Specter Design and Automotive Inc., doing business as Chez Specter, a corporation based in Montreal, Québec, Canada (the "Company," "we," "us," or "our").

2. Scope and acceptance

By accessing this website or placing an order, you agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and our Shipping, Pickup and Returns Policy. If you do not agree, please do not use this website.

These Terms apply to all visitors, customers, and others who access or use the website. Where mandatory consumer-protection legislation in your province grants you broader rights, those rights are not affected by these Terms.

3. Website and customer account use

You must provide accurate, complete, and current information when creating an account or placing an order. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that we reasonably believe are being used in violation of these Terms or applicable law.

4. Product descriptions, colours and natural variations

We make every reasonable effort to display accurate photographs, colours, and dimensions for our products. However, your screen's colour representation may differ from the actual product, and dimensions are nominal.

Chez Specter products are custom-manufactured. Natural materials such as wood and textile exhibit grain patterns, colour gradients, and surface textures that vary from piece to piece. Such variations are inherent to the materials and are not defects.

5. Prices, taxes and shipping charges

All prices are displayed in Canadian dollars (CAD) unless otherwise stated. Applicable federal and provincial taxes (GST, HST, or PST) are calculated at checkout based on your delivery or billing address.

Shipping charges are separate from product prices and are displayed at checkout or provided in a written quote before your order is confirmed. Prices shown at the time your order is accepted will not be increased unilaterally after that point.

6. Order formation and acceptance

Placing an order constitutes an offer to purchase. A binding contract of sale is formed when we send you an order confirmation email. We reserve the right, in our sole discretion, to decline any order, for example where a product is unavailable, where we suspect fraud, or where a pricing error has occurred.

If we decline your order after payment has been collected, we will issue a full refund to your original payment method promptly.

7. Preorders, deposits and production timing

Selected products are available for preorder during designated preorder windows. A 50% deposit is charged at the time of order. The remaining 50% balance is due when production is complete, before the product is shipped.

If you cancel a preorder before production has begun, your deposit will be refunded in full. Once production has commenced, we may deduct reasonable costs already incurred. We will communicate all balance due dates and production updates by email.

Production timelines are estimates and may be affected by material availability, production capacity, or other factors beyond our control. We will keep you informed of any significant changes.

8. Shipping, local pickup and delivery

Risk of loss or damage transfers to you when the carrier takes possession of your order. We will assist you in filing a claim with the carrier for goods damaged or lost in transit, and in cases of carrier loss we will work with you towards a reasonable resolution.

9. Returns and cancellations

Nothing in these Terms limits or excludes rights to which you are entitled under the applicable consumer protection legislation in your province or territory.

10. Installation and proper product use

Pegboards and related accessories must be installed following the instructions provided with the product. Failure to install correctly, overloading beyond specified capacity, or using a product contrary to its intended purpose voids any claims arising from damage attributable to such misuse.

11. Québec and Canadian statutory warranties

Nothing in these Terms limits or waives any statutory warranty, guarantee, or remedy to which you are entitled under applicable Canadian federal or provincial law, including but not limited to Québec's Consumer Protection Act (Loi sur la protection du consommateur).

Products are warranted to be free from manufacturing defects and to conform to their description. If a product is defective or non-conforming, please contact us at info@chezspecter.com within a reasonable time of discovery so we can arrange a remedy appropriate to the circumstances.

12. Limited-edition photography and intellectual property

Each limited-edition photograph offered by Chez Specter is a physical fine-art print. Purchasing a physical print transfers ownership of that physical object only; it does not transfer the copyright or any other intellectual property rights in the underlying photographic work. All such rights remain the exclusive property of Specter Design and Automotive Inc.

You may display the physical print in a private or commercial setting and may lawfully resell or transfer the physical print. You may not, without prior written permission from Chez Specter, reproduce, copy, scan, publish, broadcast, exhibit publicly, license, create derivative works from, or otherwise commercially exploit the photographic image in any medium or format.

13. Website intellectual property

All content on this website — including text, product images, graphic elements, trademarks, trade names, and overall design — is the property of Specter Design and Automotive Inc. or its licensors and is protected by Canadian copyright and intellectual property laws. You may not reproduce, distribute, or use any website content without our prior written permission, except as expressly permitted by law.

14. Privacy and third-party services

Your personal information is collected and used in accordance with our Privacy Policy.

We use third-party service providers to operate the website and process orders, including Stripe for secure payment processing and Google Analytics (with your consent) for website analytics. These providers operate under their own privacy policies.

15. Limitation of liability

To the fullest extent permitted by applicable law, the Company's liability for any claim arising from a purchase is limited to the amount paid for the product giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages.

These limitations do not apply to the extent prohibited by mandatory consumer-protection legislation in your province.

16. Changes to these Terms

We may revise these Terms from time to time. Material changes will be announced on the website, and the revised Terms will be effective from the date of publication. The Terms in effect at the time you placed your order govern that particular purchase.

17. Applicable law

These Terms are governed by the laws of Canada and the province or territory in which you reside. If you are a consumer resident in Québec, the Québec Consumer Protection Act and the Act respecting the protection of personal information in the private sector (Law 25) apply and, in the event of any conflict, take precedence over any provision of these Terms.

Nothing in these Terms restricts your right to bring a dispute before the competent authority in your province of residence.
